of a revocable, living Trust, a pour-over Will, a Durable
Power of Attorney for Business, an Advance Health Care Directive,
a Authorization to Release Health Information and a Trustee's
Certification. The standard service includes transferring
real property into the Trust, drafting assignments of interest
for business interests, and providing an instruction letter
for Trustees.
If we proceed in drafting an estate plan for you, we will
discuss your individual needs and planning tools such as lifetime
giving and integrating gifts from retirement plans. We can
also consider additional tools such as a Special Needs Trust
for beneficiaries with disabilities, and the application of
life insurance trusts or charitable trusts that may be appropriate
for large estates.
When the Settlor of a living trust dies, a Trust Administration
is required on the part of the Successor Trustee or Surviving
Trustee. Our legal services in that process include drafting
appropriate notices, assisting in the inventory and appraisal
of assets, drafting property affidavits, and guiding the Successor
Trustee through other steps that may be required by the Trust
or by financial institutions. For a married couple, this may
also include allocating the assets between sub-trusts if the
trust provides for that after the first death, which is a
critical step in minimizing estate taxes when the surviving
spouse dies.
